COMMERCIAL / INDUSTRIAL FORMS UPDATED
Over the course of the past several months, the Commercial/Industrial Committee consulted with the board's legal counsel to revise and update all of the C/I forms. The task has been completed, and all of the new forms are now available for download at the Forms Center in the Members Only section of dabr.com. If you are using older versions of the forms, please visit the site and download the new material.

If you would like a full breakdown of the changes made to these forms, along with a rationale of the revisions and how to get the most out of using them, attend the upcoming class at the board office, "Introduction to New & Improved C/I Forms". The 90-minute course will be held at 9am on September 15, and the board's legal counsel, Robert Curry, will guide attendees through all the form changes. It's only a $10 registration, and will be well worth the time and money invested to attend.

CONSTITUTION CHANGES TO BE PUT TO VOTE
At the Membership Appreciation Luncheon scheduled for Friday, October 23, 2009, a number of proposed Constitution changes will come before the membership for approval.

These proposed changes will also be mailed to each member at the beginning of October. Every member is invited, and encouraged, to attend the Membership Meeting portion of the luncheon.

In other voting news, the annual election of President-Elect and Directors will also get underway in October via online ballot. Members will receive information by email on that process just before balloting opens. Here are the slate of candidates for the Board of Directors and President-Elect for terms commencing January 1, 2010:

  • President-Elect Robert Wilson, Irongate Inc.
  • Directors (Four to be elected to serve three-year terms and two to be elected to serve one-year terms): Lisa Arzate, Coldwell Banker Heritage; Nancy Farkas, Coldwell Banker Heritage; Carolyn Jackson, Real Living Realty Services; Jan Leverett, Irongate Inc.; Ralph Mantica, Kinzeler Realty; Robert Morrison, Irongate Inc.; Tammy Murphy, Exit Realty Partners; Guy Roth, Big Hill GMAC; Mike Seagraves, RE/MAX Alliance Realty; and Robert Wolf, Prudential One REALTORS®.

Other members who wish to run for election may qualify for the election ballot by petition.

The petition process is stated in Article XI, Section 6 (b) of the DABR Constitution as follows: "Additional nomination of REALTOR® Members in good standing, who have been REALTOR® members for at least three consecutive years, may be made by petition signed by at least 10% of the REALTOR® Members in good standing. Such nomination petition must be in the hands of the Executive Vice President of the Board at least forty-five (45) days prior to the Election Date. Each petition shall contain not more than one nominee for the office of President-Elect or Director. No member of the Nominating Committee shall be eligible to sign such a petition. No person shall sign more than one petition for the office of President-Elect or Director.”

The Election Date (the date ballots are counted) is October 23, 2009. Therefore, no petition will be considered unless received at the Board office by 5 p.m., Wednesday, September 9, 2009. Election results will be announced at the October 23, 2009 annual Membership Appreciation Luncheon scheduled at the Marriott Hotel.

CONVEYANCE FEE TO INCREASE IN PREBLE COUNTY
Effective September 25, 2009, Preble County will increase its conveyance fee to $3.00 per thousand ($.30 per hundred). The transfer fee will remain unchanged at $.50 per parcel. This is a result of a recent Preble County Commission resolution (#469-09-141). Please contact the Preble County Tax Map Office at (937) 456-8129 with questions.

Opportunities

NOMINATE A COLLEGUE FOR REALTOR®, OWNER/MANAGER OR AFFILIATE OF THE YEAR
Is someone in your office actively involved in activities or committees at the Dayton Area Board of REALTORS ®, OAR or NAR? If so, why not nominate them for the prestigious Dayton Area Board of REALTORS® 2009 REALTOR®, Owner/Manager or Affiliate of the Year. These awards provide recognition to members for their service to the REALTOR® organization and community.

The nomination process is very simple, just call Kathleen Pitchel (223-0900) or email her (kpitchel@dabr.com) and give her the name of the REALTOR®, Owner/Manager or Affiliate who should be recognized. A new application process makes it easier than ever to apply. Upon submission of the nominee’s name a member of the Recognition Committee will call and complete the application by phone interview. The completed application will then be sent to the nominee for signature. The deadline for submitting the application is December 1, 2009.

The Dayton Area Board of REALTORS® has a long history of civic leadership in working with other area organizations to promote worthwhile community projects. Market Numbers

Dayton Area Home Sales Figures for July 2009

After two years of decline, existing home sales in Dayton and the surrounding areas turned the corner in July, posting very positive numbers. Sales reached a total of 1,048, 3% higher than July 2008. This marks the first increase in sales in the Miami Valley since April 2007. Read the full release
