Asset Protection from Lawsuits for Real Estate Investors (Thu. 6 Nov, 2014 1:15 pm - 4:30 pm)

Asset protection planning is the process of planning in advance to protect and preserve assets from the claims of creditors, lawsuits or other risks of loss. This can involve a wide variety of situations and many different areas of law. The key question to ask is: What or who are you protecting your assets from?  This course will explore some traditional asset protection planning techniques and the use of domestic (Ohio) and offshore trusts for asset protection with special emphasis for real estate investors and persons in the real estate business.

Attorneys Tom Kendo and Jeff Gammell will keep you focused and involved while reviewing the importance of title examination as related to pertinent statutory and case law.  Understand the legal distinctions between opinions, guarantees and title insurance. Review the practical application and risks of title issues, probate and escrows.  Find out why every buyer should consider title insurance and specifically review the language in the Board’s purchase agreement about Title Insurance. Review sources of authority from statutory laws, case studies and State Bar title standards while examining legal forms of title evidence documents. What are the legal risks and practical applications of title underwriting and the legal issues of escrow, good funds and defalcation. Review the licensee duties regarding protection of client’s best interest, duties regarding disclosure and care.
